AMD XPressNow!sm Service Terms and Conditions
Introduction: AMD will begin processing your request for warranty service for your AMD Processor under AMD’s Processor in a Box Limited Warranty (the “Limited Warranty”) when you contact AMD’s Technical Service Center by phone, (408) 749-3060, and speak and provide requested information to a representative. You must then send to AMD the AMD Processor to which your warranty request pertains (the “Subject Processor”). AMD will inspect the Subject Processor and confirm whether it will provide that warranty service, in accordance with the terms and conditions of the Limited Warranty (see your Certificate of Authenticity or www.amd.com for the full text of the Limited Warranty). In the interim, AMD will immediately furnish you with a replacement AMD Processor, subject to the terms and conditions of this Agreement.

A. Description of AMD XPressNow! Service.Subject to the following terms and conditions, upon receipt of your reply e-mail or facsimile (fax) indicating you agree to these terms, AMD will immediately furnish to you a replacement AMD Processor, comparable to the Subject Processor. The replacement AMD Processor will be shipped to you at the address you have provided. In order to receive a replacement AMD Processor under the AMD XPressNow! program, you must:
  1. Be registered as a AMD Reseller. You may register as a reseller at www.amd.com, and follow the links to “sell AMD products.”
  2. Reply to the electronically submitted agreement with the words “I agree,” ALONG WITH THE Return Material Authorization (RMA) NUMBER YOU WERE PROVIDED OVER THE PHONE FOR THE REQUEST, in the email subject line if by email, or printed on the first page of the agreement if faxed, no later than 1:00 PM (Pacific Time), Monday through Friday, excluding holidays, on the requested shipping date for the replacement AMD Processor.
AMD will waive any charge for the purchase price for the replacement AMD Processor furnished to you under the AMD XpressNow! program, provided all the following occur:
  1. AMD must receive the Subject Processor with heat sink and fan at the AMD address listed above, within thirty (30) days of the date of your e-mail acceptance of these terms. Failure to return the Subject Processor may preclude you from this expedited service in the future. In accordance with the terms of the Limited Warranty, you are responsible for all costs and expenses incurred in connection with the return of that Subject Processor to AMD; and
  2. AMD confirms that the Subject Processor, and your request for warranty service for that Subject Processor, is within the scope of the Limited Warranty therefore.
Any replacement AMD Processor furnished by AMD to you under the AMD XPressNow! program will be subject to all of the provisions of AMD’s Limited Warranty.

B. Claims Outside the Limited Warranty. In the event that AMD reasonably determines that the AMD Processor that you return is outside the scope of the Limited Warranty, AMD will notify you by e-mail, fax, or phone. AMD will return that AMD Processor to you unless otherwise agreed to by the parties.

C. Title and Risk of Loss. Title, risk of loss, and right of possession shall pass from AMD to you at the time Federal Express makes a first attempt at delivering the replacement processor at your address listed above.

D. EXCLUSIONS. AMD shall not be responsible or held liable in whole or in part:
  1. for any delays in shipping, handling or delivery once AMD has deposited the replacement processor with Federal Express for delivery to you.
  2. for any delays related to email, server, facsimile, or telephone issues, whether AMD is aware of any such issues.
  3. for any delays in delivery related to customs inspections, clearance, or any other reason related to customs.
  4. for any delays in or failure of delivery to rural locations.
  5. for any delays in failure of delivery due to incomplete or incorrect address or information.
  6. for non-delivery because recipient refuses to accept shipment, address cannot be located or place of business is closed, or no appropriate person was available to accept shipment .
  7. for the act, default or omission of any person or entity other than AMD, including those of any local, state or federal government agencies.
  8. for any individual who misrepresents themselves, or incorrectly signs on behalf of, the person whom ordered the service.
E. Number Limit on Service. AMD XPressNow! is limited to no more than five (5) advance replacements for which AMD has not received from Reseller the Subject Processor and no more than a cumulative total of five (5) advance replacements per thirty (30) day period.

F. Right to Discontinue Service. AMD reserves the right to discontinue the AMD XPressNow! service at any time for any reason.

G. Privacy Policy. AMD values its customers and respects their privacy. We do not sell, rent or share any information you provide to us with any the third parties. When you sign up for AMD XPressNow!, we will use your information to process your order. We may also need to contact you by phone, email, postal mail or facsimile if you have any questions regarding your order.
